The controller for personal data processed through this website is ACM Group GmbH i.G. (Alliance Critical Materials), Berlin, Germany. Privacy-related enquiries may be sent to info@acmfund.eu. This notice applies to visitors to this website and to individuals who contact ACM through the contact details published on the site.
Contact and business communications
If you contact ACM by email or through another business communication channel, we process the information you provide, such as your name, organisation, role, contact details and the content of your enquiry. We use this information to respond, evaluate potential business or investment relationships, maintain relevant correspondence and, where appropriate, take steps requested by you before entering into a business relationship. The legal basis is Article 6(1)(b) GDPR where processing is necessary for pre-contractual steps or a contract, and otherwise Article 6(1)(f) GDPR based on our legitimate interest in conducting and managing professional communications and relationships.
Website hosting and technical data
This website is hosted using Webflow. When you access the site, technical data may be processed to deliver and secure the service, including IP address, browser and device information, requested URL, referring URL, date and time of access, and server or security log information. We process such data where necessary to provide a secure and reliable website on the basis of Article 6(1)(f) GDPR. Our legitimate interests include website operation, security, error diagnosis and protection against misuse.
Cookies and analytics
ACM has not configured advertising trackers, Google Analytics or other non-essential analytics on this website. Webflow or underlying infrastructure may use strictly necessary technical storage or similar technologies required to deliver, secure or operate the website. Where access to or storage of information on your device is strictly necessary, this is carried out in accordance with Section 25(2) TDDDG. If ACM later introduces non-essential analytics or tracking technologies, this notice and the website's consent mechanism will be updated before activation.
Recipients and international transfers
Personal data may be processed by service providers that support hosting, website security, communications and related business operations, only to the extent required for those services. Webflow, Inc. and its subprocessors may process data outside the European Economic Area, including in the United States. Where required, transfers are safeguarded through recognised transfer mechanisms such as the EU-U.S. Data Privacy Framework and/or the European Commission's Standard Contractual Clauses. We do not sell personal data provided through ordinary business enquiries.
Retention
We retain personal data only for as long as necessary for the purposes described in this notice. Technical logs are retained in accordance with the operational and security settings of the relevant service provider. Business correspondence is retained while the relationship or enquiry remains relevant and thereafter as necessary to meet statutory retention, limitation, compliance or evidentiary requirements. Data is deleted or anonymised when it is no longer required and no legal obligation or overriding legitimate interest requires continued retention.
Your data-protection rights
Subject to the conditions of the GDPR, you may have the right to access your personal data, request correction or deletion, restrict processing, receive data in a portable format, and object to processing based on legitimate interests. Where processing is based on consent, you may withdraw that consent at any time for the future. You also have the right to lodge a complaint with a competent data-protection supervisory authority. For ACM's Berlin-based activities, this may include the Berlin Commissioner for Data Protection and Freedom of Information. Requests may be sent to the contact details above.
Provision of data and automated decisions
You are not legally required to provide personal data through this website. If you choose not to provide information that is necessary for us to answer an enquiry or take requested pre-contractual steps, we may be unable to respond or proceed. ACM does not use this website to make decisions based solely on automated processing, including profiling, that produce legal or similarly significant effects.
